Trial of pope's ex-butler in "Vatileaks" case opens

VATICAN CITY (Reuters) - Pope Benedict's former butler went on trial on Saturday for using his intimate access to the pope's desk to steal and leak explosive documents in what he said was an attempt to clean up corruption in the Vatican.

The 46-year-old Paolo Gabriele, who served the pope his meals and helped him dress, was being tried along with a Vatican computer expert in the city state's little-used tribunal, a small, wood-paneled room with a papal emblem on its ceiling.

Gabriele was arrested in May after police found confidential documents in his apartment inside the Vatican, throwing a global media spotlight on an institution battling to defend its reputation from allegations of graft.

A three-judge panel will decide the fate of Gabriele, whom the pope used to call "Paoletto" (little Paul), now described in Vatican documents as "the defendant".

The self-styled whistle-blower, who says he was trying to expose graft at the headquarters of the Roman Catholic Church, is charged with aggravated theft for stealing and leaking the pontiff's personal papers, and could be jailed for four years.

Only eight journalists were allowed into the courtroom, and these were due to brief other reporters after the end of the first session, which was expected to last up to three hours.

According to an indictment last August, Gabriele told investigators he had acted because he saw "evil and corruption everywhere in the Church" and wanted to help root it out "because the pope was not sufficiently informed".

The documents pointed to a power struggle at the Church's highest levels.

Gabriele, who said he saw himself as an "agent of the Holy Spirit", is widely expected to be found guilty because he has confessed.

"He has done harm by leaking this information because there will always be somebody who will take advantage of these things to denigrate the Church," said Rome resident Sergio Caldari in Saint Peter's Square.

"OPENNESS AND TRANSPARENCY"?

Another local onlooker, Giovanni Maisto, said he was hopeful that the trial could mark "a new dimension of openness and transparency" in the Church's affairs.

The trial will be based on a 19th-century Italian penal code. Claudio Sciarpelletti, the computer expert charged with aiding and abetting Gabriele, could be jailed for up to a year.

It is not clear how long the trial might last.

Gabriele, a father of three who lived a simple but comfortable life in the city-state, told investigators after his arrest in May that he believed a shock "could be a healthy thing to bring the Church back on the right track".

His arrest capped nearly five months of intrigue and suspense after a string of documents and private letters found their way into the Italian media.

The most notorious of the letters were written to the pope by Archbishop Carlo Maria Vigano, currently the Vatican's ambassador to Washington, who was deputy governor of the Vatican City at the time.

In one, Vigano complains that when he took office in 2009, he discovered corruption, nepotism and cronyism linked to the awarding of contracts to outside companies at inflated prices.

Vigano later wrote to the pope about a smear campaign against him by other Vatican officials who were upset that he had taken drastic steps to clean up the purchasing procedures.

Despite begging not to be moved away, Vigano was later transferred to Washington by Secretary of State Cardinal Tarcisio Bertone, effectively the Vatican's prime minister.

Since the papal state has no prison, Gabriele would serve time in an Italian jail, though the pope is widely expected to pardon him.

Ron Howard's remarks played at Mayberry Days

RALEIGH, N.C. (AP) ? Andy Griffith led by example on the set of his television show, teaching a 6-year-old boy that true leadership requires not only confidence and hard work but also humility, Academy Award-winning film director Ron Howard said in recorded remarks Sunday.

Howard's remarks were to be played during a Griffith tribute at the 23rd annual Mayberry Days celebration in Mount Airy. It's the first Mayberry Days held since Griffith, a native of Mount Airy, died July 3 at the age of 86 at his home in Manteo. The three-day event typically attracts 25,000 to 30,000 people.

"Andy's impact on my life and my approach to my work really can't be measured," Howard said. "The balance that he sustained between focused, creative effort and this overt, playful enjoyment that he got out of working hard with people that he liked, doing a show he loved, was something that I hope I'll always remember and emulate."

Howard played Opie Taylor, the red-headed son of Sheriff Andy Taylor, on "The Andy Griffith Show." The CBS TV show aired from 1960 to 1968, starting when Howard was 6 years old and ending when he was 14.

Tanya Jones, executive director of the Surry Arts Council, said Howard reached out to her and told her he wanted to "do something for Andy," adding that he knew Griffith loved his hometown. He emailed Jones after she had reached out to his father, actor Rance Howard, for help with the celebration that's held in the North Carolina town that inspired the fictional town of Mayberry.

Ron Howard hinted that what he learned on "The Andy Griffith Show" helped him with his future career, which includes an Academy Award for directing "A Beautiful Mind." Griffith, he said, established an inclusive set that allowed him, at age 6, "to feel safe, comfortable enough to participate and then to be able to witness and learn so much about the collaborative process ? the value of originality, the discipline of form and the bursts of individual inspiration that good moments and scenes are built on."

Rance Howard sent a statement praising Griffith's character to be read at the tribute.

"Andy was an excellent role model, the guardian of good taste and humor," wrote Rance Howard. "He loved to laugh out loud and long but his motto was, 'I don't want the public to laugh at us, I want them to laugh with us.'"

Griffith was recovering from a heart attack when Rance Howard's wife, Jean, died. Griffith flew with his wife, Cindi, to California so he could speak at the memorial service.

"That's the kind of friend Andy was," Rance Howard wrote. "Yes, he played an enormous role in our lives."

Ron Howard said he learned during the eight seasons "how much care had to go into making a program if it was going to be truly worthy of an audience's time.

"...He helped me to understand that high achievement and leadership require confidence, yes, hard work, absolutely. But it could be gained while still maintaining humility, humanity and a joyous appreciation for those around him. Like so many others, I'm going to miss you, Andy."

With his last words for the crowd, Howard mimicked Griffith, who was famous for telling the audience three words at the end of his shows: "I appreciate it."

iLuv iSP245 Mo'Beats Speaker Stand


There are plenty of Bluetooth speaker?options out there?some are spectacular, while some are pretty uninspiring. The iLuv iSP245 Mo'Beats ($99.99 direct) sits somewhere in the middle, delivering sound quality that suffers from heavy distortion at max volume, which itself isn't all that loud. Its saving grace is its sleek design, which also functions as a stand to prop up pretty much any tablet in both landscape and portrait orientations. It's best to think of the Mo'Beats as a miniature TV or movie viewing setup than a dedicated music playback speaker.?

Design
The iLuv Mo'Beats resembles a skinny aluminum barrel, measuring about 1.75 inches in diameter and 9.31 inches in length, with a small lip on the front for propping devices up. At 1.09-pounds, the Mo'Beats is not quite as portable as options like the Logitech UE Mobile Boombox ?or the Jawbone Jambox , but its solid aluminum frame and stand function make up for the added weight.

Inline

There are circular speaker grilles at either end of the barrel, while a black plastic protrusion on the back houses the On/Off switch, 3.5mm Aux jack, mini USB port, and a slide-out stabilizing bar for heavier and taller devices. The recess in the lip is about half an inch wide, making it suitable for even overly thick tablets, while embedded rubber pads help keep devices in place. There are no volume or playback controls, as everything is handled on the device. There is also no speakerphone like on the UE Mobile Boombox or Jambox.

Pairing the speaker with a Bluetooth device is simple enough; just flip the switch from Off to On and select the Mo'Beats on your device. The Mo'Beats can only pair with one device at a time, which is less useful than the Mobile Boombox, which can pair with up to eight devices at a time.

Performance
To put it bluntly, the iLuv Mo'Beats is not the speaker you want if high-quality audio is your biggest concern. It's louder, clearer, and has better stereo separation than the built-in speakers on most tablets, but that's really not saying much. Compared with alternatives like the Logitech UE Mobile Boombox, the Mo'Beats sounds pretty tepid. Not only does it distort heavily at high volumes, the volume itself isn't even all that loud. Bass is seriously lacking, and songs with heavy bass, like the Knife's "Silent Shout," suffer from unbearably crunched and distorted sound.

On more balanced tracks that don't go overboard with bass, and at moderate volumes, the Mo'Beats does a decent job, but still ends up sounding a bit too thin and treble-heavy for my taste. The vocals and guitar strumming on a track like "Babel" by Mumford & Sons sound a bit too harsh, while the cymbal crashes of the drums overpower the mix. Playing the same track back on the UE Mobile Boombox reveals just how much warmth is lost with the Mo'Beats.

It's not a dock, but its stand makes it a good option for a desktop mini home theater. For movie watching purposes, the speakers on the Mo'Beats actually do a respectable job. That same treble-heavy sound makes voices sound loud and clear. A trailer for The Avengers sounded exciting, with easy-to-hear dialogue and loud explosions that really popped. At the end, however, the score highlights lower register string instruments and percussion that became crunched and distorted at high volumes. If money is no object, the JBL OnBeat Xtreme ($499.95 direct) delivers powerful and high-quality audio, and it can also dock iPads in both vertical and horizontal orientations.

The iLuv iSP245 Mo'Beats isn't the best speaker for audio enthusiasts?not by a long shot. What it does offer is a useful stand that can boost the volume of your tablet, and its speakers do a good job for dialogue and background sounds in movies. The Logitech UE Mobile Boombox is still the Bluetooth speaker you want to get in this price range, but for those looking for an all-in-one stand and speaker solution, the Mo'Beats is, at least, a slick and well-built option.

Israeli Prime Minister Benjamin Netanyahu's use of a cartoon-like drawing of a bomb to convey a message over Iran's disputed nuclear program follows in a long and storied tradition of leaders and diplomats using props to make their points at the United Nations. Here are a few memorable examples:

US shows embassy bug to expose Soviets

In May 1960, U.S. Ambassador Henry Cabot Lodge accused the Soviets of espionage, producing before the Security Council a wooden Great Seal of the United States which had been presented by a group of Russian citizens at the U.S. Embassy in Moscow. Lodge then extracted a tiny microphone out of the eagle's beak with a pair of tweezers, and said dozens of listening devices had been found in U.S. embassies in communist bloc countries. "From what plays were these props taken and when will it open?" the Soviet delegate responded. Earlier that month, the Soviet Union had shot down an American U-2 spy plane over Russia.

He accused Iraq of hiding chemical and biological weapons and reviving their nuclear bomb project. He said it posed a grave threat to the world. After the invasion of Iraq, it emerged that reports of Saddam Hussein's WMD program were false.

New Housing Market Policies Put Transferees in Good Position to Buy

Working for a relocation company, I?m privy to real estate trends in a variety of markets across the country, as well as the country as a whole. Surely, housing numbers are constantly fluctuating, but if you look at patterns over longer periods of time, they can tell you something important. Real estate has been my business for the past 25 years, so I?ve sailed through the ups, weathered the downs and managed through everything in between. That?s why I try to put housing numbers, and policies, into a broader perspective. Essentially, what is good for today may not be good for tomorrow ? and if it?s not good for tomorrow, are we really any better off in the long run? And is it important if we are?

In an effort to stir the economy, the FED recently announced that it will buy 40 billion dollars a month in mortgage bonds.? The theory is that cheaper funds will improve the sluggish housing market.? Although interest rates have remained at, or near, record lows for quite some time, this decision is an attempt to make more money available, and housing more affordable, for ?more people.? Does this sound familiar?

Politics aside, there is a problem with this scenario.? And, yes, we?ve seen it before. This set up will create similar problems to those that arose from sub-prime lending.? As more money becomes available at a lower interest rate, purchase power for home buyers will go up across the board.? For the same monthly payment, people will be able to buy a more expensive home.? But, so can everyone else.? The net effect is that home prices will start to creep up due to supply and demand.

In an election year, this looks great because the housing market is appearing to grow.? As home values increase, property taxes will also go up which will help prop state and local coffers. This would all be great ? if it was genuine. But, once again, this is a non-market driven artificial stimulus.? What happens when the FED stops pouring money into the mortgage bond market?? We can hope the recovery will pick up steam by that point, but there are no guarantees. The greater possibility is that, much similar to the Cash for Clunkers stimulus, housing sales will fall flat again in the following months as home prices have been inflated and cheap loans will have dried up.

As a result, now is a good time to buy and here is why:

  • The bond buying has just begun.? Interest rates are the lowest they have been, and the home prices are just beginning to climb. Today, you will be able to purchase a home closer to its real market value which will help you down the road when it is time to sell.
  • This is the off season.?? The busy spring and summer seasons have come to an end and there is still a significant inventory on the market. ?With fewer buyers actively looking, sellers are eager to unload their properties.
  • The rental market is tight.? Even with low interest rates, lenders are hesitant to loan money to anyone with debt loads and credit scores previously quite acceptable.? Therefore, the rental vacancy rate has dropped, forcing remaining options? to go up in price. This always makes home ownership, with its deductible mortgage interest, more attractive.
  • If you are upsizing, it is still a good move. The value you loose on a lower priced home should be offset by the value gained in a higher valued home that has lost the same percentage value.

Lenders are still cautious, so financing a home may still be a challenge.? If you have transferees who are moving, the first thing they will need to do is discuss their creditworthiness with at least one, if not two, reputable lenders.? Not only will this help them to focus on the right range, but they will also receive counsel on the right moves to make to maintain or achieve an acceptable credit score.

Further, ensure that your transferees have access to experts so that they can make informed decisions about buying and selling their homes with these new policies on deck.

Samsung Mobile Print (for iPad)


I had wanted to test Samsung Mobile Print (for iPad) since I saw the app demonstrated about a year ago, and finally got the chance when we got a Samsung Wi-Fi enabled multifunction printer (MFP) in for review at PC Labs. Despite a few glitches, it's easy to use, and has a good range of printing and scanning options. This free app is a must for anyone with an iPad and a Wi-Fi-enabled Samsung printer or MFP.

Basics
Samsung Mobile Print (for iPad) is available for free through the iTunes app store; the universal app is compatible with both the iPhone and iPad (as well as the iPod touch)?an Android version is also available. It lets you print to any Samsung wireless or network-connected printer or multifunction printer (including USB-connected models) on the same LAN as your iPad, and scan from any Samsung MFP on the network. I tested this app using an iPad 2 and a Samsung CLX-6260FW multifunction printer.

The app will automatically detect Samsung networked printers, but in certain cases (such as if the printer is USB connected), you may have to add it manually, a simple process described in the Help menu.

Once you've selected the printer, you're ready to print or scan. At the top of the screen is a bar with four items: Print, Scan, About, and Help.

Printing
When you touch the Print icon, you enter the printing half of the app, and are presented with six choices: Photo, Camera, Web, Document, Clipboard, and Google Docs.

You can print documents you've saved in your document folder, either ones you've scanned or ones you've imported to your iPad. It prints documents in standard Office, image, and PDF formats. It will print photos at a range of paper sizes, in portrait or landscape orientation, in color or grayscale, in simplex (one-sided) or duplex (two-sided).

Printing from the clipboard is a useful function. You can print text or images copied from Web pages and applications that support copying. You can add bookmarks, but you can't import them. The app did reasonably well in formatting Web pages for printing, though occasionally it would crop off the top of a document. Another glitch is that it would sometimes preview pop-ups (after I'd closed them) rather than the article I was trying to print.

Google Docs is the only cloud-based service directly supported by Samsung MobilePrint. You can print documents shared from some other services such as Dropbox, but you have to first access the document in that service, select Open In and choose Samsung Mobile Print. The app does not list which such services are supported.

In printing, as well as scanning, I occasionally got a Low Memory warning, after which the app would fail to perform the intended function. Sometimes, it was in obviously memory-intensive tasks (like scanning at high resolution), sometimes not. It was unclear whether the memory issues were with the iPad (I tested with an iPad 2), the printing process through the app, or both, though they were more frequent than I'd experienced in testing other similar print apps with my iPad.

Scanning
Using Samsung Mobile Print on the iPad has one big inherent advantage over using it on an iPhone: when you scan to the device, the tablet's screen is large enough for easy and convenient reading.

You can scan either to Documents (a folder solely for scanned documents) or Photos (your photo stream), or to both. In scanning to Documents, you can choose between PDF, PNG, and JPEG; scanning to Photos is JPEG-only.? You can choose color or grayscale; low, normal, or high quality; and sizes including 3.5 by 5, 4 by 6, 5 by 7, letter, legal, and A4; and scanning from the flatbed or ADF.

Scanning was problem free apart from occasional low memory crashes. These occurred most frequently when scan quality was set to high.

Exchanging Files
There are several ways of transferring files from a computer to your iPad and the app: through iTunes, a server, a Web browser, or mapping a network drive. They're described thoroughly in Help. iTunes is dependable, and using a Web browser (by entering your iPad's server URL, which is easy to find through the app) is very easy.

Help
Tapping Help brings up a pull-down menu, divided into seven sections: Samsung MobilePrint, Choosing a device, Printing, Scanning, File Sharing, Customization, and Troubleshooting. Touching any of the items within one of these sections brings up instructions, such as Printing Content from the Clipboard. I found the instructions to be clear and concise. At the bottom of the page are a Home button, which takes you back to the drop-down menu, and right and left arrows to move through Help item by item.

As is the case with free apps from printing manufacturers, Samsung Mobile Print only prints to and scans from its own (Samsung) printers. Still, it does a decent job in comparison with such apps from other manufacturers. It doesn't have native support for the range of cloud-based services that the Editors' Choice Epson iPrint 2.0 (for iPad) provides, though it prints as wide a variety of file formats. HP ePrint Home & Biz v. 4.1 (for iPhone) lacks integration with cloud-based services. Samsung Mobile Print has a better range of scanning functions than either, though I didn't experience the Samsung app's memory issues (when printing or scanning) with them.

A Worthy Samsung Mobile Print App
Samsung Mobile Print (for iPad) is an easy-to-use app with a variety of printing and scanning options and convenient file transfer between your computer and the app. Printing and scanning were occasionally hobbled by memory issues, the Web browser experience could be improved, and better integration with cloud-based services would be helpful. (You can only directly print from within the app from Google Docs.) It's not quite up to joining (the Epson-only) Epson iPrint 2.0 as a mobile printing app Editor's Choice, but for Samsung Wi-Fi printer owners with an iPad, this free app is a boon to mobile printing and a must to download.

Today?s post is for all the women out there who want to be a fitness model. We?ve been lucky enough to convince Christine Schmieden to give us the real-life strategies that will allow you to carve your niche in the fitness modelling world.

Be True to Yourself

Don?t change for anyone. Draw a line in the sand and decide for yourself what you are willing to do to achieve your goal of becoming a fitness model. Only you can decide what is best for you in the making of a good, positive and sustainable career.

Be mindful of what image you portray at all times; what you ?put out there? and how people perceive you. What I?m trying to say is ? keep it PG. You don?t work as hard as you do for someone to compare you to a lady of the night.

WNSO Pro Ava Cowan can attest to this. In a recent interview on bodybuilding.com, Cowan describes the scrutiny she felt for publishing more ?racy? bikini images from one of her first shoots. In no time she discovered, ??if you want to be on the cover of Oxygen, or Muscle and Fitness Hers?you need to get some pictures that give you validity as an athlete??

Be selective ? Be Cautious ? When Introducing Yourself to the Industry

Don?t take every opportunity that comes along ? be cautious and always do your research. Ask for client information, backgrounds and websites, as well as portfolios, of photographers and agencies. A legitimate photographer or agency should have all these items at your request and should be more than willing to share their work and references. If not, it may be for the best to pass up an opportunity ? when just starting out; your safety should be top of mind.

Have a friend who is a photographer, or an acquaintance? Don?t be afraid to reach out to them and ask to swap time for talent ? they shoot and get to build their portfolio at the same time you do.

Be a Role Model ? Not Just a Face or Body

When you?re a fitness model, all eyes and ears are on you at all times. You aren?t just a pretty face or 6-pack abs; you?re a role model ? the image of health and fitness ? don?t take that lightly. Men and women alike will look to you for a positive image of health. What you do on and off the stage/shoot matters. Stand for something aside from yourself ? be selfless ? and have the drive to want to help people and make a difference in their lives by being a public figure for health and fitness.

What Differentiates You From the Rest

Answer the question of why? Why would someone want to sign you, feature you, photograph you, sponsor you ? that answer will help secure your success. With that, begin marketing yourself ? what can you offer folks that will make them want to work with you and book you over another model? Secure a fan base; consider developing a website, utilize social media and post profiles on reputable websites like modelmayhem.com and bodybuilding.com. Submit your bio and images online and in-person; and submit often. Don?t let rejection get you down ? submit again. Be proactive, and not reactive.

Do you compete? It isn?t necessary; though some athletes make the transition from competing on-stage to fitness modeling. Competing can also give you an edge over others as you create a name, reputation and awareness for yourself as an athlete.
Also, attend fitness expos, events and workshops ? all potential places for media exposure and connecting with other athletes, photographers and folks in the industry (Mova, 2012).

Practice Makes Perfect

Do your homework and practice posing ? find which positions work best to show off your features. Essentially; BRING IT! ?You don?t have to have the best body in the world; it?s not about that. It?s about showing off YOUR physique in YOUR best angles, together with the facial expressions that meet the needs of that particular shoot and client? (Ythjall, 2011).

The last shoot I was on, everyone on set was silent ? it was odd. So, I asked, ?everything alright?? To which the designer replied, ?everything?s great?you know you?re doing incredible when we don?t say a word?. I did my homework ? identified with what the client was looking for before I stepped foot on shoot, and delivered.

So, come prepared to a shoot with a sense of what works best for you. And, if provided direction, take it ? every photo shoot is essentially an opportunity to learn; the folks on location are professionals and are there to be sure you look your best. They?ll help you hit your posing, but do your part first and bring something to the table.

Also, do your research and be familiar with the ?big name? photographers, agencies and magazines in the industry. These are the folks you want to work with some day. You wouldn?t go into a job interview unprepared, would you?

Keep Your Body in Check

Eat clean and continue to train in order to maintain a physique that could accommodate a shoot within two weeks ? it?s a great piece of motivation to help keep you in tip-top shape for a shoot. Sometimes, you won?t have more notice than two weeks for an upcoming shoot.

The Portfolio

Professional photos aren?t necessary for success, neither is a professional portfolio ? at first. You can get a decent start if you have a good digital camera that can produce quality images. You?ll want a headshot, full body front, back and side shot, as well as a chest up image handy for submitting online or in person. You can be concerned about a portfolio as you continue to develop your career and get booked for work.

On Location ? in Summary

Be kind ? be gracious ? be professional; no one likes a diva and that sort of attitude will not get you work. Thank EVERYONE you encounter on a shoot ? from the photographer to the person that brings you coffee. They are there to ensure your success; you should do the same for each individual you work with each day. And finally, be yourself. Have faith, confidence and stay strong. The road ahead is not easy; otherwise everyone would be on it. ?It starts with a vision, it?s fueled by desire, & it?s executed by will. You gotta know what it will take & be willing to do it? As Fishes Migrate, Their Food Might Not Follow

Ocean species seeking cooler waters to survive may have to adapt to their new environments by changing their diets

Monterey, Calif.?As Earth's atmosphere heats up due to global warming, the world's oceans will warm, too. All kinds of creatures, from the smallest plankton to the largest fishes, will be forced to adjust. Some of them may be able to adapt by altering their body chemistries, but the most likely response?for those that are free to travel (unlike oysters, say)?is simply to move.

Indeed, certain species of fish are migrating away from mid-latitude oceans toward cooler waters such as the Arctic Ocean, according to recent studies. Scientists are finding that, in general, larger ocean organisms such as fishes have less tolerance for temperature change than the microorganisms they consume, such as phytoplankton. So it is possible that as fishes migrate, their preferred food sources may not. To survive, the migrants may have to change their diet once they reach their new neighborhoods. Some of the most recent findings are being released for the first time at a symposium here this week called The Ocean in a High-CO2 World.

Of course, the fishes that already live in colder oceans may not appreciate the arrival of newcomers that could compete for their food. Yet the native species have their own challenges. Research is showing that fishes native to colder waters are even less tolerant of temperature changes than those in warmer waters, according to Hans-Otto P?rtner at the Alfred Wegener Institute for Polar and Marine Research in Germany. "The temperature range that fish are comfortable in decreases as latitude rises," he says. Over time, then, the mix of species could change. In cold northern waters, for example, sardine populations are dropping but anchovy populations are rising.

Other factors come into play: Increasing carbon dioxide emissions worldwide are making all oceans more acidic, forcing species to use more energy to adapt, leaving them with less energy to reproduce and grow. Oxygen levels in certain ocean regions are dropping, adding a third stressor to acidification and temperature rise. Scientists are beginning to unravel how these multiple stressors are affecting species across large spans of ocean, but much more data and analysis is needed. In the meantime, increasing numbers of species may be on the move. What they will eat once they reach their destinations, and which ocean inhabitants they may have to compete with, remains to be seen.

Finance house reserves right to increase fee paid to receiver ? CCJ ...

The Caribbean Court of Justice (CCJ) ruled that a finance house (business that loans money) has the legal right to increase the fees paid to its receiver (somebody appointed to run a business).
All nine CCJ judges who heard the following case came to the same conclusion.
The company, Guyana Furniture Manufacturing Limited, had asked the CCJ to rule that the Inter-American Investment Corporation had no power to increase the fees of receiver, Robert Ramcharan, without first consulting with it.
The case was brought following the furniture company?s failure to repay loans borrowed from the Inter-American Investment Corporation (?Inter?) and from the National Bank of Industry and Commerce in Guyana. Inter appointed Mr. Ramcharan acted as receiver in accordance with a mortgage debenture the company had executed.
By way of explanation, debentures are legal instruments large companies give to lenders as security for loans made to the companies. A debenture is used to certify a loan, and serves as evidence that a company must repay the lender a set amount of money with interest.
In a debenture there are usually provisions for the company to grant the lender a charge over property owned by the company and a power to appoint a receiver in the event of the loan not being duly repaid. Once appointed, the receiver will manage the company?s business as a going concern if possible but, if need be, the receiver can sell the charged property to enable the lender to be repaid. The receiver is paid a commission which comes out of the income and assets of the company.
This case called on the CCJ to examine whether a receiver?s commission could be increased by the lender without first consulting the company. The claimant in the case, Guyana Furniture Manufacturing Ltd., executed two debentures. The first debenture was executed in March 1993 with Inter. Under this debenture, Inter loaned US$500,000 to the company with a charge on the company?s property and equipment.
In October 1998, the company executed a second debenture in favour of the Bank, charging the same property and equipment. The two debentures ranked equally.
Each one allowed for the appointment of a receiver in the event the company failed to repay the loans. The Bank?s debenture specified that for any receiver appointed under it the receiver would be paid a rate of commission to be agreed as long as the rate did not exceed 10% of the gross amount of monies received by the receiver.
The company defaulted on its payments to both lenders, and in March 2001, the Bank appointed Mr. Robert Ramcharan as receiver of the company?s property. The Bank and Mr. Ramcharan agreed on a commission of one per cent of all funds received by him.
In April 2002, however, the Bank and Mr Ramcharan agreed to increase Mr. Ramcharan?s commission to three per cent to compensate him for assuming additional responsibility for management of the Company in order to improve its profitability.
Mr. Ramcharan operated as Receiver from October 2001 until February 2004, when the receivership came to an end. In the mean time, Inter appointed its own receiver, Mr. Maurice Solomon, who operated as Inter?s receiver from January 2003 to February 2004.
The company brought a claim to the High Court, contending that the increase in Mr. Ramcharan?s commission was illegal because the company did not consent to it and that therefore Mr Ramcharan was wrongly overpaid $11,100,888; and the company was owed US $21,592, which it claimed was illegally paid by Mr Ramcharan to Mr. Solomon as part of the latter?s commission.
The company stated that Mr Solomon?s fees had already been paid by Inter. The High Court dismissed the company?s claims, but ruled that the sum of $19,459 ? an overpayment to Mr. Ramcharan according to the Court?s calculations ? was to be returned to the company.
The Court ruled that the company?s consent was not required in order for the Bank to increase the receiver?s commission, and that there was no evidence of any payment by Inter to its receiver. The company appealed the decision, and its appeal was rejected by the Court of Appeal. The company subsequently brought a further appeal to the Caribbean Court of Justice (CCJ).
The CCJ found that the standard position under debentures is that the obligations and remuneration of a receiver appointed by the lender are necessarily agreed upon only by those parties. Simply put, there is no contractual relationship between a receiver and a debtor, and the receiver therefore has no obligation to the debtor.
The Court stated, ?Nothing in the debenture required the Company to be involved in either fixing or increasing the commission. The outer limit of the commission was fixed at 10 per cent thereby permitting an increase to any rate below that percentage on terms mutually agreed upon between the bank and Mr Ramcharran?.
The Court also agreed with the courts in Guyana that Mr Ramcharan did nothing wrong in paying Mr Solomon?s commission out of the company?s funds since there was no evidence suggesting that Inter had itself paid its receiver.
The Court therefore ruled that the payment of US $21,592 to Mr. Solomon by Mr. Ramcharan was in keeping with the Inter debenture agreement as it was paid out of the funds collected on the company?s behalf. Finally, the Court ordered that the company pay the legal costs of both Mr. Ramcharan and the Bank. In this case, interestingly, all nine judges who heard the case came to the same conclusions.

Sergio Franchi concert thrived despite tornado warnings

STONINGTON ? The 18th annual Sergio Franchi Memorial concert survived thunderstorm and even tornado warnings Sept 8 and though it started more than an hour and a half early, triggered repeated ovations from a crowd of about 3,600, only a little smaller than the norm.

Even though Eva Franchi?s mother Anyu had passed away just seven days before the concert, Franchi hosted the event as usual and dedicated it not only to the memory of her late husband, Sergio ? who inspired her to hold the concerts 18 years ago -- but to Anyu as well.

The concerts have raised more than $1 million in scholarships awarded to talented tenors and sopranos since its inception, but shortly before 1 p.m. Franchi announced that though this year?s version was scheduled to begin at 3 p.m. it would start in 30 minutes to beat the impending storm.

It did.

But 16 talented singers, introduced with the usual flair by Franchi, did not let the bad weather warnings and early start affect their performances. Simply put, they sang their hearts out.

Franchi introduced Soprano Latonia Moore, who sang at her concert last year and was a cover (understudy) for the lead singer in ?Aida? at the Metropolitan Opera in NY last March., by saying:

?Thank God the lead got sick to Latonia got her chance.?

Moore drew raves from The NY Times and other reviewers for her unexpected performance and Saturday, sang ?Ritgorna Vincito? from ?Aida? with the same power and vocal artistry she did at the Met.

Though the program listings were changed because of the approaching storm, Moore came back to sing ?Un bel di? from ?Madam Butterfly to loud applause and was followed by Australian singer Alfio, who repeated his triumph of last year by singing ?Il Mondo? and then brought the house down with a moving ? guitar-backed rendition of ?Mamma? which he dedicated to all mothers everywhere and especially to Anyu.

Jesus Garcia belted out a powerful, big-voiced version of ?Granada, Jon Dominick brought bravos with a deeply moving rendition of ?Old Man River? and Stevin LaBrie lit up the stage with ?Some Enchanted Evening.? Continued...

Giada Valenti sang her signature number, ?La Vie en Rose, which she has performed all over the world with passion and intensity and later returned to sing ?Smile.?

Laurence Broderick was in top form with ?This is My Beloved? and so were Eric Margiore with ?E Lucefan le stele? from ?Tosca? and Corinne Winters and Margiore with a romantic and chemically alive duet performance of ?O soave fanciulla? from ?La Boh?me.?

Filippo Voltaggio with his ?It?s Not Unusual? excited the crowd and so did Jacqueline Ballarin with her unusual presentation of ?Don?t You Know? which she then segued into ?Quando me ?en vo? from ?La Boh?me,? -- the melody on which it was based. She then ended her performance, her voice soaring, with the final bars of ?Don?t You Know? to loud applause.

The three and half hour concert, broken only by a 15 minute intermission, climaxed with long and sustained high notes from the ?Sergio Franchi Young Tenors? including spectacular performances of ?O Sole Mio.?

They drew repeated standing ovations and Franchi clearly moved by her singers and the crowd that showed up in force despite the dire weather forecasts, thanked them from coming and said her 250-acre estate would continue to be the site of what she called the Connecticut version of the Met ? though tickets cost just $30.

1 city sees jobs in nuclear waste

Carlsbad hires lobbyist at $15,000 a month to find new projects

After 13 years of operating safely and in obscurity, New Mexico?s underground repository for transuranic radioactive waste is nudging back into headlines.

A highway project by the state proposes to temporarily change the route of loaded trucks traveling from the north to the Waste Isolation Pilot Plant near Carlsbad.

The planned road reconstruction, still a month from being voted on by the New Mexico Transportation Commission, has cast renewed attention on WIPP. But that project is nothing compared to the ideas of Carlsbad-area politicians, who want to build their region?s employment base by establishing even deeper ties to the nuclear-disposal industry.

?WIPP is one of the greatest unsung success stories around, a project with a perfect safety record and more of a game changer for our economy than even oil and gas,? said Eddy County Commissioner Jack Volpato, a Republican. ?I see it or maybe something else like it creating a whole new generation of jobs.?

In particular, Volpato said, Carlsbad and Eddy County will push for a federal study to determine if a second repository similar to WIPP could safely bury high-level nuclear waste from defense projects.

Such an endeavor would maintain or add well-paying jobs in the Carlsbad area. It also would solve an environmental problem for the country, Volpato said.

The idea of taking nuclear waste from the rest of America and salting it away under the desert is not radical thinking in Carlsbad, which has been a neighbor to WIPP since 1999. For many people, nuclear-waste disposal is pure business now, not a cause for worry.

?I was a skeptic when WIPP came here. Then I educated myself and I have become entirely comfortable with it,? Volpato said.

The county commissioners and the Carlsbad City Council recently voted to hire a Washington lobbying firm at a cost of $15,000 a month to pursue more business opportunities in radioactive disposal, said City Administrator Jon Tully.

Two commissioners and two council members dissented, but the area is moving ahead to market itself as a safe place to deposit nuclear waste.

Tully said the duties of the lobbying company, the C2 Group, would be narrowly focused on nuclear research and projects that could create jobs for Carlsbad.

These could include interim storage of certain wastes, expansion of WIPP?s mission in burying transuranic waste and perhaps other undertakings to help in nuclear clean-ups. ?

Under the federal law that created WIPP, the repository can only accept transuranic waste from government sites that had a defense mission. These included operations in eight states, notably Los Alamos in New Mexico, Rocky Flats in Colorado and the Savannah River site in South Carolina.

Last year, U.S. Rep. Steve Pearce introduced a bill to expand WIPP?s mission, saying about 200 good jobs would be in jeopardy if nothing was changed.

Pearce proposed that WIPP be allowed to accept government-owned transuranic waste not related to defense missions. One example of this is the West Valley site south of Buffalo, N.Y. It was a commercial venture used as a nuclear fuel reprocessing center.

Just like the ongoing shipments from defense sites, this waste could be trucked to WIPP and deposited in ancient salt beds 2,150 feet below the earth's surface.

Volpato said such concepts for sustaining WIPP while cleaning up environmental messes remain possible. But the area?s lobbying effort also could seek other types of business, perhaps eventually the high-level nuclear waste from defense operations.

?People seem to have heard of Yucca Mountain but not about us,? Volpato said of the defunded Nevada repository.

The oncoming nuclear campaign by Carlsbad and Eddy County probably will re-ignite opponents of WIPP, Volpato said. His bet is that most people can be won over, provided that the scientific research shows a new nuclear mission can be handled as safely and efficiently as WIPP has been.

As for the state highway project, Tully said city officials still had questions about the plan but expect to resolve them in meetings with the New Mexico Department of Transportation.

Gary Shubert, the engineer for NMDOT?s division in southeastern New Mexico, said the state needs to improve the base of New Mexico 200, a designated WIPP route. Shubert described it as a two-lane road with the peaks and valleys of a roller coaster.

The state proposes to close a portion of it next year. That means an estimated 560 transuranic waste shipments to WIPP would take an alternate route in the Carlsbad area.

Trucks would depart from U.S. 285 southbound at New Mexico 524. Then they would go east to Canyon Street before continuing onto U.S. 62/180.

Shubert said this route is about a half-mile longer than the existing path to WIPP.
